Overview

Before you start using Mirror OS, please take a few minutes to read these Terms of Service. They're important and will tell you what you can and can't do.

Important: These Terms include an arbitration provision. This means that if you have a dispute with us, you may have to resolve it through arbitration rather than in court. You won't be able to file a class action lawsuit against us. Please read the Dispute Resolution section carefully.

1. Acceptance of Terms

Hofund Inc ("Mirror", "we", "us", or "our") provides you access to its website, web application, and related services (collectively, the "Site") subject to your agreement to follow these Terms of Service ("Terms").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please exit the Site immediately and do not use any of the Site Content.

"Site Content" means all content on or through the Site, including text, software, source code, applications, images, audio files, video files, articles, AI-generated reflections, and other information or content.

By agreeing to these Terms, you are also agreeing to our Privacy Policy and Use of AI Policy.

2. Description of Service

Mirror OS is a behavioral operating system designed to help you build daily structure, interrupt old patterns, and activate intentional living through guided morning, midday, and evening routines. The service uses artificial intelligence to generate personalized reflections based on the information you provide.

Mirror OS is not a substitute for professional mental health care. If you are experiencing a mental health crisis or need professional support, please seek help from qualified healthcare providers or contact emergency services.

3. Personal and Non-Commercial Use

The Site is for your personal and non-commercial use only. You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works of, transfer, or sell Site Content, except for your use of the Site as expressly permitted in these Terms
  • Access or attempt to access any systems or servers on which the Site is hosted, or modify or alter the Site in any way
  • Forge headers, create a false identity, or otherwise manipulate identifiers to deceive others or disguise the origin of Site Content
  • Use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site
  • Use the Site to generate content for commercial purposes, train competing AI systems, or resell the service
  • Attempt to reverse engineer, decompile, or extract the source code or underlying algorithms of the Site or AI systems

4. User Content

"User Content" refers to any information, data, text, or other content you submit to Mirror OS through the daily cycles or other features.

By submitting User Content, you grant Mirror a non-exclusive, royalty-free, worldwide license to use, store, process, and analyze your User Content to:

  • Provide and improve the services
  • Generate AI reflections and insights for you
  • Train and improve our AI systems using anonymized, aggregated data
  • Conduct research and analytics

You retain ownership of your User Content. We will handle your User Content in accordance with our Privacy Policy.

5. Access and Use Requirements

To access the Site, you will need a working internet connection via a computer or mobile device, for which you are responsible for all costs, expenses, and fees.

The Site is intended for use solely by individuals who are:

  • At least 18 years old
  • Able to enter into a legally binding agreement
  • Located in the United States

By using the Site, you represent and warrant that you meet these requirements. If you do not meet these requirements, you must immediately cease using the Site.

6. AI-Generated Content

Mirror OS uses artificial intelligence to generate reflections, insights, and other content based on your inputs. You acknowledge and agree that:

  • AI-generated content is for informational and reflective purposes only and should not be relied upon as professional advice
  • AI-generated content may contain inaccuracies, errors, or be unsuitable for your specific situation
  • The AI does not replace human judgment, professional consultation, or mental health care
  • You are responsible for evaluating and using AI-generated content appropriately

7. Intellectual Property

Copyrights

All Site Content, including its organization and presentation, is protected by copyright law. Mirror and its licensors own the copyright, and you may not use it without permission except as expressly permitted in these Terms.

Trademarks

"Mirror", "Mirror OS", and related logos and names are trademarks owned by Mirror or its licensors. You may not use these marks without prior written permission.

8. Term and Termination

We may terminate your access to the Site at any time, for any reason, with or without notice. If you violate these Terms or engage in conduct that is harmful to others, we may immediately terminate your access.

Upon termination:

  • Your right to access the Site will cease immediately
  • Your locally stored data will remain in your browser until you clear it
  • We may retain data as necessary for legal compliance, dispute resolution, and enforcement of our agreements

The following sections survive termination: Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Dispute Resolution.

9. Third-Party Links

The Site may contain links to third-party websites ("External Sites"). We provide these links for convenience only and do not endorse or control External Sites. Each External Site has its own terms and privacy policy, and we are not responsible for them.

10. Disclaimer of Warranties

THE SITE, SITE CONTENT, AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Mirror disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranties of title and non-infringement
  • Warranties that the Site will be uninterrupted, secure, or error-free
  • Warranties that defects will be corrected
  • Warranties regarding the accuracy, reliability, or completeness of Site Content
  • Warranties that AI-generated content will be accurate, appropriate, or beneficial

Mirror does not warrant that the Site or its servers are free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIRROR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the Site
  • Damages resulting from reliance on AI-generated content
  • Damages caused by the Site being unavailable or not working properly
  • Unauthorized access, use, or alteration of your data
  • Any conduct or content of any third party on the Site

This limitation applies regardless of the legal theory (warranty, contract, tort, negligence, or otherwise) and whether or not Mirror has been advised of the possibility of such damage.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mirror, its officers, directors, employees, agents, suppliers, and licensors from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

  • Your violation of these Terms
  • Your use of the Site
  • Your User Content
  • Your violation of any rights of a third party

13. Dispute Resolution and Arbitration

THIS SECTION AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY.

Binding Arbitration

To the extent permitted by applicable law, you and Mirror agree that any disputes arising in connection with the Site or these Terms will be resolved by binding arbitration rather than in court.

Arbitration is more informal than a lawsuit. It uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited court review. Arbitrators can award the same damages and relief that a court can award.

Waiver of Jury Trial

BY AGREEING TO THESE TERMS, YOU AND MIRROR ARE VOLUNTARILY WAIVING ANY RIGHT TO A JURY TRIAL FOR ALL DISPUTES COVERED BY THIS AGREEMENT TO ARBITRATE.

Waiver of Class Action

YOU AND MIRROR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Arbitration Rules

Any arbitration will be governed by the Consumer Dispute Resolution Procedures of the American Arbitration Association (AAA) and will be administered by the AAA. The AAA Rules are available at www.adr.org.

Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in court for violations of intellectual property rights.

14. Governing Law

Except for the arbitration provision above, these Terms and your use of the Site will be governed by the laws of the State of California, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms at any time. The updated version will be posted on the Site with an updated date. Your continued use of the Site after changes are posted constitutes acceptance of the new Terms.

For material changes, we may notify you by email or by prominently posting a notice on the Site.

16. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy and Use of AI Policy, constitute the entire agreement between you and Mirror regarding the Site.
  • Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations.
  • No Agency: These Terms do not create any agency, partnership, or joint venture relationship between you and Mirror.
